Migrating to Australia (Family)

This page provides supplementary information on a number of migration options for bringing partners or family members of Australian citizens, Australian permanent residents or eligible New Zealand citizens to Australia.

Partners

All Prospective Marriage visa (subclass 300) and Partner (subclass 309/100) and applications must be lodged online via ImmiAccount. Paper applications will not be accepted.  

Prospective Marriage (Subclass 300)

This visa lets you come to Australia to marry your prospective spouse who is an Australian citizen, Australian permanent residents or eligible New Zealand citizens and then apply for a Partner visa.

Partner visa – apply overseas (Subclasses 309 and 100)

The visa allows the partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia.  You apply for the temporary (Partner (Provisional)) visa and the permanent (Partner (Migrant)) partner visas at the same time

Child

Children from overseas do not have an automatic right of permanent residence in Australia and must apply for the appropriate visa and be assessed against and meet all the legal criteria before a visa can be granted.  You cannot lodge this visa online.

All Child and Orphan Relative visas (Subclasses 101, 102, 445, and 117) must be lodged directly with the Department of Home Affairs office in Perth, Australia. Applications can only be accepted if sent to the below address:

Child Visa (Subclass 101)
This is a permanent visa for children overseas who are a dependent child (natural, adopted or step children) of an Australian citizen, Australian permanent resident or eligible New Zealand citizen.

Dependent Child Visa (Subclass 445)
This is a temporary visa for a child or stepchild of a parent who holds a temporary partner visa and has not yet been granted a permanent partner visa.  The same person sponsoring the child’s parent must sponsor the child.
